Law and Order

I was sitting and listening to C-SPAN, as I quite often do, and there were some reports on the Taliban stoning women for adultery and even stoning a couple for eloping (calling even THAT adultery).  My first thought was “How moronic, eloping isn’t adultery!”

This type of behavior hits a series of neurons in my brain that have a few other topics connected to them; incest, rape, child molestation, murder, and legal/social/human/animal law.  I differentiate between these because legal does not mean moral (if you believe in morals) and animal societies are much different than human societies (despite the fact that we too are animals).  There are differences that I would consider for the better and some that I would consider for the worse, which brings me to why all of these topics link to the same set of neurons in my neuron impoverished skull.

First let me clarify something;  I am well aware of the complexities and necessity of “Innocent Until Proven Guilty” and in no way believe the accused should have no rights at all.  The following opinions apply mainly to those who are guilty of what was done without question (IE: caught in the act).  So I’ll try to focus on the specifics rather than go in to any depth on the broader topics.  To be blunt, I strongly feel that people that rape, murder, commit incest, and molest children (I’ll refer to these as the “Things That Shall Not Be Named” going forward) should be summarily terminated.  No fanfare, no sensational news, just termination;  good-bye, then end.  These activities violate the foundations of human society and I believe that it should be removed.  I’m aware that my opinion starts to sound like a eugenics doctrine of the 1920’s or the third Reich, but I believe I have a sound basis for it.

The laws of most animals (mammals in our case) dictate that any member of the group that is a serious detriment to the group should be removed from the group.  It’s called animal law (BTW, I also believe that acts of violence should be judged under animal law as well;  two people fighting are getting what they deserve so let them beat the crap out of each other).  What a “serious detriment” is generally gets defined by survival and harmony.  On the up side this means that Things-That-Shall-Not-Be-Named get removed but it also means that animals have little tolerance for members with disabilities, quirkiness and individuality.  Humans, on the other hand, have developed a good tolerance, even a celebration of, disabilities, quirkiness and individuality.  I believe that humans also have an over-tolerance of Things-That-Shall-Not-Be-Named as a result.

The big hitch here is that humans are not only capable of but are very adept at … lying.  Animals, generally, do not and can not lie per se.  So the application of animal-law justice to cases of things-that-shall-not-be-named become complicated when balanced with our value of ALL human life.  How do you sort out the liars?  I suppose that’s why we have a labyrinth of laws to guide us … or confuse us … something like that.

I certainly don’t have THE answer but I do know a few things;  1) Someone who will defend a rapist/murderer’s rights to a quality of life will quickly change their mind in the face of either themselves being raped or their spouse or child being raped/murdered.  2) Capitol punishment is not designed to be a deterrent and I wish lobbyists would stop making that a point of contest.  Capitol punishment is to simply remove the person from society permanently.  3) People deserve to get what they give, and often times even ask for it as such.  Not really the eye-for-an-eye deal but more like Newton’s Law of Motion (every action has an equal and opposite reaction).

It seems more and more to me that what I see as missing are solid principals in people.  We’ve been taught for too long that everything is relative when really it’s not.  What people get caught up in is when the principal gets violated.  What do you do with someone who has killed another person?  In my opinion, when a person violates a principal like killing is wrong they have forfeited the application of that principal to themselves.  I guess this is also why hypocrites infuriate me so much.

In any case my goal is surround myself with good people and not to sweat the small stuff.

p.s.  Whenever I hear cases of Things-That-Shall-Not-Be-Named I get very disturbed and unsettled overall, especially if I see it on TV or something.  I generally debrief myself in dream states, when I sleep at night, where I happen across some pervert in the act and I shoot them with my .45.  Generally in the face.  Then I feel better.
